The Enforcement of Offender Supervision in Europe: Understanding Breach Processes

Although there has been much research on community sanctions in Europe, less work has been done on the processes in place for non-compliance and when offenders breach an order or their conditions of early release. This book examines the processes of breach in the context of unpaid work orders and early release from prison across a range of different European jurisdictions. Drawing on research from Belgium, Spain, Greece, Italy, Lithuania, England and Wales, Germany, Malta, Ireland, Sweden, Scotland, the Netherlands and Hungary, this book considers the degree and nature of discretion exercised by decision-makers; the roles and responsibilities of the different actors involved in the breach process; and legitimacy, due process and procedural requirements.
